Welcome to Shnippet, an online platform that allows users to share code snippets and interact with other users. These Terms and Conditions govern your use of the Shnippet website, located at shnippet.com. By using the Shnippet website, you agree to be bound by these Terms and Conditions.
Acceptance of Terms
By using the Shnippet website, you agree to these Terms and Conditions, as well as our Privacy Policy, which is incorporated by reference into these Terms and Conditions. If you do not agree to these Terms and Conditions or the Privacy Policy, you should not use the Shnippet website.
Eligibility
The Shnippet website is intended for users who are 18 years of age or older. If you are under 18, you may use the website only with the involvement of a parent or guardian.
User Accounts
To access some of Shnippet features you will need to register for an account as an individual and consent to these terms. If you do not consent to these terms, Shnippet reserves the right to refuse, suspend or terminate your access to Shnippet.
You are solely responsible for ensuring that your account registration is complete and remains up to date. You have the right to discontinue use of, or terminate, your account whenever you like, and subject to our Privacy Policy, control the use and sharing of your account information.
Please note that any content or information you share publicly is governed by the terms described below in the section titled “Content Permissions and Restrictions,” and you should be aware that once you place content in the public sphere, you willingly give up some rights and control over such content.
Shnippet strongly encourages you to review our Privacy Policy, which explains how we will handle, process, and use your personal data, and with whom, and how we will share this data.
You are solely responsible for obtaining and maintaining any equipment or ancillary services needed to connect to or access the website, including without limitation modems, hardware, software, and long distance or local telephone service. You are solely responsible for ensuring that such equipment or ancillary services are compatible with the website.
Some premium or additional features of Shnippet may require a payment obligation for access and use. You are solely responsible for ensuring that your payment obligations, if any, remain current and not in arrears. In the event Shnippet charges for features you will be clearly notified of the terms of any payment obligations and provided the opportunity to refuse such obligations before you incur any charges. Please note, however, that your refusal to accept payment obligations may result in your inability to access or use certain premium or additional features of Shnippet.
Content Permissions and Restrictions
All materials displayed or performed on Shnippet, including but not limited to text, graphics, logos, tools, photographs, images, illustrations, software or source code, audio and video, and animations (collectively “website content”) (other than website content posted by individual “Subscriber Content”) are the property of Shnippet and/or third parties and are protected by United States and international copyright laws (“Shnippet Content”).
All trademarks, service marks, and trade names are proprietary to Shnippet and/or third parties and use of the website means you agree to abide by all copyright notices, information, and restrictions contained in any website content accessed through the website.
The website is protected by copyright as a collective work and/or compilation, pursuant to U.S. copyright laws, international covenants, and other copyright laws. Other than as expressly set forth in these terms, you may not copy, modify, publish, transmit, upload, participate in the transfer or sale of, reproduce (except as provided in this Agreement), create derivative works based on, distribute, perform, display, or in any way exploit any of the website content, software, materials, in whole or in part. You may download or copy Shnippet Content, and other items displayed on Shnippet for download or personal use provided that you maintain all copyright and other notices contained in such Public Content.
Any other downloading, copying, or storing of any Shnippet Content (other than Subscriber Content) for other than personal, noncommercial use is expressly prohibited without prior written permission from Shnippet or from the copyright holder identified in the copyright notice per the Creative Commons License. In the event you download software from Shnippet (other than Subscriber Content) the software including any files, images incorporated in or generated by the software, the data accompanying the software (collectively, the “Software”) is licensed to you by Shnippet or third party licensors for your personal, noncommercial use, and no title to the Software shall transfer to you. Shnippet or third party licensors retain full and complete title to the Software and all intellectual property rights therein.
Subscriber Content
You agree that any and all content, including without limitation any and all text, graphics, logos, tools, photographs, images, illustrations, software or source code, audio and video, animations, and product feedback (collectively, “Content”) that you provide to Shnippet (collectively, “Subscriber Content”), is perpetually and irrevocably licensed to Shnippet on a worldwide, royalty-free, non-exclusive basis pursuant to Creative Commons licensing terms (CC BY-SA 4.0), and you grant Shnippet the perpetual and irrevocable right and license to access, use, process, copy, distribute, export, display and to commercially exploit such Subscriber Content, even if such Subscriber Content has been contributed and subsequently removed by you as reasonably necessary to, for example (without limitation):
- Provide, maintain, and update Shnippet
- Process lawful requests from law enforcement agencies and government agencies
- Prevent and address security incidents and data security features, support features, and to provide technical assistance as it may be required
- Aggregate data to provide product optimization
This means that you cannot revoke permission for Shnippet to publish, distribute, store and use such content and to allow others to have derivative rights to publish, distribute, store and use such content. The CC BY-SA 4.0 license terms are explained in further detail by Creative Commons, and the license terms applicable to content are explained in further detail here. You should be aware that all Public Content you contribute is available for public copy and redistribution, and all such Public Content must have appropriate attribution.
As stated above, by agreeing to these terms you also agree to be bound by the terms and conditions of the Acceptable Use Policy incorporated herein, and hereby acknowledge and agree that any and all Public Content you provide to Shnippet is governed by the Acceptable Use Policy.
Embedding Snippets
Shnippet allows users to embed code snippets on their own websites using an iframe. By embedding a code snippet on your website, you agree to give proper attribution to Shnippet.com by including a link back to the original snippet page on Shnippet.com. You may not modify or alter the code snippet in any way that would violate the Creative Commons license under which the code snippet is shared.
Shnippet reserves the right to remove any embedded code snippets that violate these Terms and Conditions or for any other reason without notice. Shnippet does not endorse any embedded code snippets and disclaims any and all liability in connection with embedded code snippets.
User Actions
Users may upvote code snippets shared on the Shnippet website and leave comments. Shnippet reserves the right to remove any comments that it deems to be inappropriate or in violation of these Terms and Conditions.
Indemnification
Users agree to indemnify and hold Shnippet and its affiliates, officers, agents, and employees harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of their use of the Shnippet website, their violation of these Terms and Conditions, or their violation of any rights of another.
Copyright Policy
Shnippet respects the intellectual property rights of others and expects users to do the same. Shnippet will respond to claims of copyright infringement in accordance with the Digital Millennium Copyright Act (“DMCA”). If you believe that your work has been copied in a way that constitutes copyright infringement, please notify Shnippet’s Copyright Agent in writing and provide the following information: (i) a physical or electronic signature of the copyright owner or a person authorized to act on their behalf; (ii) identification of the copyrighted work claimed to have been infringed; (iii) identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Shnippet to locate the material; (iv) your contact information, including your address, telephone number, and email address; (v) a statement by you that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and (vi) a statement that the information in the notification is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
Disclaimer of Warranties
The Shnippet website is provided “as is” and without warranties of any kind, either express or implied. Shnippet does not warrant that the website will be uninterrupted or error-free, nor does it make any warranty as to the accuracy, completeness, or reliability of any information obtained through the website. Users are responsible for taking all necessary precautions to ensure that any content obtained from the website is free of viruses or other harmful components.
Limitation of Liability
In no event shall Shnippet be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with these Terms and Conditions, even if Shnippet has been advised of the possibility of such damages. This limitation of liability applies to all damages of any kind, including but not limited to loss of data, loss of profits, or any other damages arising out of or in connection with the use or inability to use the Shnippet website.
Modification of Terms
Shnippet reserves the right to modify these Terms and Conditions at any time. Any changes will be effective immediately upon posting of the modified Terms and Conditions on the Shnippet website. Your continued use of the Shnippet website after the posting of the modified Terms and Conditions will signify your acceptance of the changes.
Termination
Shnippet may terminate or suspend your access to all or any part of the website at any time, with or without cause, with or without notice, effective immediately. Upon termination, you must immediately cease all use of the website.
Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any principles of conflicts of law. Any legal action arising out of or relating to these Terms and Conditions shall be brought exclusively in the state or federal courts located in San Francisco, California.
Entire Agreement
These Terms and Conditions constitute the entire agreement between you and Shnippet with respect to the use of the Shnippet website, and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and Shnippet.
